Welcome to the NaK™ Equine website (“Site”). These Terms & Conditions (“Terms”) govern your access to and use of this Site, including the purchase and use of all NaK™ Equine products, content, services, and related materials provided by NaK™ Equine (“Company,” “we,” “our,” or “us”).

By accessing this Site, placing an order, or using our products, you agree to be bound by these Terms. If you do not agree to these Terms, you should discontinue use of the Site and refrain from purchasing our products.

2. ELIGIBILITY & ACCEPTANCE OF TERMS

By using this Site, you represent that:

3. PRODUCT INFORMATION & DISCLAIMER

NaK™ Performance products are intended exclusively for equine use.

Our products are formulated to support normal hydration and electrolyte replenishment in horses during exercise, transport, environmental stress, and performance activities.

Statements made on this Site have not been evaluated by the U.S. Food & Drug Administration. Products sold by NaK Performance are not intended to diagnose, treat, cure, or prevent any disease.

Information provided on this Site is for general educational and informational purposes only and does not constitute veterinary, medical, or nutritional advice.

Customers should consult a qualified veterinarian or equine nutrition professional regarding individual horse needs.

4. FEEDING RESPONSIBILITY & SAFETY

The purchaser and horse owner assume full responsibility for:

• appropriate product use;

• feeding practices;

• monitoring horse condition;

• water availability;

• storage conditions; and

• compliance with veterinary guidance.

Customers agree to:

• feed products according to label directions;

• introduce products gradually where appropriate;

• provide unrestricted access to fresh water;

• discontinue use if adverse reactions occur; and

• consult a veterinarian when necessary.

NaK Performance shall not be responsible for misuse, overfeeding, improper storage, or failure to follow feeding recommendations.

5. NATURAL INGREDIENT VARIABILITY

NaK™ Bar products contain natural ingredients including, but not limited to:

• oats

• prune purée

• flaxseed

• minerals

• salts

As a result, natural variations may occur between batches, including:

color, texture, firmness, aroma, moisture content, surface appearance and shape. Environmental exposure, including heat, humidity, freezing temperatures, or shipping conditions, may affect product texture or appearance without impacting intended use.

Such natural variation does not constitute a product defect.

6. PERFORMANCE & COMPETITION DISCLAIMER

Horse performance outcomes depend on numerous factors outside the control of NaK™ Performance, including:

conditioning, training, veterinary care, climate, workload, travel, genetics, rider management and feeding programs.

NaK Performance makes no guarantee regarding:

athletic performance, competition outcomes, recovery rates, hydration status or individual horse response.

Customers are solely responsible for verifying compliance with the rules, regulations, and prohibited substance policies of any competition organization, federation, racetrack or governing body.

7. ASSUMPTION OF RISK

Horse ownership, training, handling, transport and competition activities involve inherent and unpredictable risks.

By purchasing or using NaK™ Performance products, you acknowledge and accept all risks associated with equine management and agree that NaK™ Performance cannot control or guarantee:

individual horse behavior, feeding practices, environmental conditions, transportation conditions, veterinary status, exercise intensity, hydration practices or management decisions.

You voluntarily assume all risks associated with the use of our products.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, NaK™ Performance, its owners, affiliates, officers, employees, contractors, suppliers and agents shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages arising from:

product use, inability to use products, website access, shipping delays, product texture changes, feeding decisions, competition outcomes, or equine health conditions.

This limitation includes, without limitation:

veterinary expenses, transportation costs, boarding expenses, lost profits, loss of business, competition losses, emotional distress, property damage and loss of use.

In all circumstances, the total maximum liability of NaK™ Performance shall not exceed the purchase price actually paid for the product giving rise to the claim.

9. RELEASE & INDEMNIFICATION

You agree to indemnify, defend and hold harmless NaK™ Performance and its affiliates, owners, employees, contractors and representatives from and against any claims, damages, liabilities, losses, costs or expenses, including reasonable attorneys’ fees, arising from:

misuse of products; violation of these Terms; improper feeding practices; negligence; violation of applicable laws; or claims arising from horse ownership or management.

10. ORDERS & PAYMENT

All prices are listed in U.S. Dollars unless otherwise stated.

We reserve the right to:

• modify pricing at any time

• discontinue products

• limit quantities

• refuse or cancel orders

• correct pricing or typographical errors

• restrict sales in certain jurisdictions

Orders are not considered accepted until payment has been successfully processed and shipment confirmation has been issued.

11. SHIPPING POLICY

NaK™ Performance currently ships within approved service regions determined at our discretion.

Estimated shipping timelines are non-binding and may vary due to:

weather, carrier delays, holidays, supply chain interruptions, customs processing or other circumstances beyond our control.

Risk of loss transfers to the purchaser upon delivery of the shipment to the carrier.

Customers are responsible for providing accurate shipping information. NaK™ Performance is not responsible for delays or losses resulting from incorrect shipping information supplied by the customer.

12. RETURNS, REFUNDS & PRODUCT CLAIMS

Due to the consumable nature of equine feed products, opened or partially used products are not eligible for return unless required by law.

Claims involving:

• damaged products

• incorrect orders

• or shipping issues

• must be submitted within seven (7) days of delivery

NaK Performance may require:

• photographs

• lot numbers

• packaging retention

• or additional documentation to evaluate claims

Refunds, replacements, or credits are issued solely at the discretion of NaK™ Performance.

13. INTELLECTUAL PROPERTY

All content on this Site, including but not limited to:

trademarks, logos, product names, text, graphics, photographs, packaging designs, formulations, videos, marketing materials and website design is the exclusive property of NaK™ Performance or its licensors and is protected by applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, or used without prior written consent.

“NaK™” and related branding may be protected under trademark laws.

14. WEBSITE USE RESTRICTIONS

19. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and NaK™ Performance regarding the use of this Site and supersede all prior communications or agreements relating to the subject matter herein.

21. MODIFICATIONS TO TERMS

NaK™ Performance reserves the right to modify these Terms at any time without prior notice.

Updated Terms become effective immediately upon posting to this Site.
